Giftling
Terms of Use

In short
- Giftling is an iPhone app for keeping track of gifts. Your lists live in your own iCloud. Giftling does not run an account system or a server for that data.
- Sharing a household uses iCloud sharing. You decide who is invited.
- Giftling does not sell the gifts on a list and does not take payment for them.
- The iPhone app is not on the App Store yet.
1. Agreement
These terms are an agreement between you and Marcus Twichel (“Giftling,” “we,” “us”) for the Giftling iOS app and the website at giftling.app. The Privacy Policy explains how information is handled. It is part of these terms.
By using the app or this website, you agree. If you don’t agree, don’t use Giftling.
2. The service
Giftling helps you keep people, dates, gift ideas, and gifts on your iPhone, and sync them through iCloud. You can share a household with other iCloud users. The website describes the app and links to these terms, the privacy policy, and support.
Giftling does not sell the gifts on a list, does not take payment for those gifts, and does not promise that an item is available or appropriate. A gift you record is a note for you and, if you share it, for the people in that iCloud share. It is not an order.
The app is described on this website as coming soon. A feature shown here may change before the first version you can download. Sync depends on Apple, your network, and your iCloud account, and it can be unavailable at times.
3. Your iCloud, not a Giftling account
Giftling does not create an account, does not offer email sign-in, and does not ask you to choose a Giftling password. The app uses the iCloud account already on your device. Apple’s terms apply to that account, to CloudKit, and to iCloud sharing.
You are responsible for the Apple ID on the device and for who can unlock it.
4. Who can use Giftling
You need to be at least 13 years old, or older if the law where you live requires a higher age to agree to these terms. Apple may require its own age and iCloud eligibility rules before sync or sharing will work.
5. Your content
You keep ownership of the names, dates, notes, and other material you add (“your content”). Giftling writes it into your device and your iCloud so the app can show it to you and, when you share a household, to the people you invite. We do not take a license to host that content on a Giftling server, because we do not operate one for it.
You promise that you have the rights you need for your content, and that adding it does not violate someone else’s rights.
6. Sharing
Sharing uses Apple’s iCloud sharing. You choose participants in the system share sheet, and you can stop sharing there. People with access can see and change the shared household, within the permission you set.
Records you mark private, including gift ideas and gifts for a person marked private, stay in your private iCloud database and are not part of the share. Share a household only with people you are comfortable showing it to.
7. Acceptable use
Don’t:
- break the law, or help someone else do that
- harass, threaten, or impersonate anyone
- add content you don’t have rights to
- mislead people about a gift, a list, or who you are
- try to break or disrupt the app, or to read another person’s private iCloud database
8. The App Store
There is no App Store listing yet. When the iOS app is available, you will download it from Apple, and Apple’s terms will also apply to that download. Apple is not responsible for Giftling and does not have to maintain or support it. Support for Giftling is at giftling.app/support.
If Apple requires it, Apple and Apple’s subsidiaries are third-party beneficiaries of these terms as they apply to the iOS app, and may enforce those terms against you. Any claim that the app fails to meet a warranty can be directed to us. To the extent Apple requires a refund remedy, Apple may refund the purchase price of the app, if you paid one. Apple has no other warranty obligation for Giftling, to the maximum extent the law allows.
9. Price
Giftling does not charge a fee of its own. iCloud storage you use is between you and Apple. If a paid feature is added later, the App Store listing will show the price before you are charged, and Apple will handle that payment.
10. Our intellectual property
The Giftling name, the app, and this website belong to us or our licensors. These terms do not give you that ownership. You may share a link to the site. You may not copy the branding or present your own product as Giftling.
11. Feedback
If you send an idea or suggestion, we may use it without owing you payment or a promise to keep it confidential, unless we agree otherwise in writing.
12. Third-party services
iCloud, CloudKit, and the App Store are Apple services. Their terms and privacy practices are Apple’s. A link you add in the app may open another product. That product is not Giftling.
13. Disclaimers
Giftling is provided “as is” and “as available.” To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that sync or sharing will be uninterrupted or error-free. Those depend on Apple and on your device.
Some places do not allow these disclaimers. In those places, they apply only as far as they can. You may have rights that cannot be waived.
14. Limits on liability
To the extent the law allows, Marcus Twichel will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, or for the cost of a gift someone did or did not buy, even if we were told that kind of loss was possible.
To the extent the law allows, our total liability for claims relating to Giftling is limited to the greater of the amount you paid us for Giftling in the three months before the claim, or fifty U.S. dollars (US $50).
These limits do not apply where the law forbids them, including liability that cannot legally be capped.
15. Stopping
You can stop using Giftling at any time, delete your lists in the app, and remove the app’s iCloud data through Apple.
We can stop offering Giftling. If we do, we will try to say so on this website when that is reasonable. Your iCloud data remains subject to Apple’s terms.
16. Changes
We may update these terms. We will change the date at the top and post the new version on this website. If you keep using Giftling after the update applies, you are agreeing to the updated terms. If you don’t agree, stop using Giftling.
17. Disputes
If you have a problem, email contact@giftling.app first and give us a chance to make it right. Please include a short description of what happened. These terms do not require arbitration, and they do not waive the right to bring a class action.
18. Other terms
If a court holds one part of these terms unenforceable, the rest still applies. Waiting to enforce a term does not waive it. You may not assign these terms without our consent. We may assign them if Giftling is transferred.
These terms, together with the Privacy Policy, are the whole agreement between you and us about Giftling. They don’t create rights for anyone else, except for Apple as described in the App Store section.
